Virginia Wholesale Drug Distributor Licensing Guide

Overview

Wholesale drug distributors operating in Virginia or shipping prescription drugs into the Commonwealth must obtain a license from the Virginia Board of Pharmacy. Virginia requires both resident and non-resident distributors to hold active licenses, with no exceptions for entities licensed in other states. The licensing framework is governed by the Virginia Drug Control Act (§ 54.1-3300 et seq.) and enforced through comprehensive regulations addressing facility operations, personnel qualifications, and supply chain security.

Regulatory Authority

The Virginia Board of Pharmacy (VABOP or VA BOP) regulates wholesale drug distributors under the authority of the Virginia Department of Health Professions (DHP). Statutory authority derives from:

  • § 54.1-3300 et seq.: Virginia Drug Control Act — establishes the comprehensive framework for drug regulation in Virginia
  • § 54.1-3415: Specific licensing requirements for wholesale distributors and third-party logistics providers
  • § 54.1-3415.1: Requirements for third-party logistics providers specifically
  • 18 VAC 110-50: Regulations Governing Wholesale Distributors, Manufacturers and Warehousers — comprehensive regulations covering facilities, operations, recordkeeping, and compliance requirements

The Board maintains regulatory oversight through initial licensing, facility inspections, renewal processes, and enforcement actions. Board offices are located at Perimeter Center, 9960 Mayland Drive, Suite 300, Henrico, VA 23233-1463. The Board's website is www.dhp.virginia.gov/pharmacy.

Who Must Be Licensed

Entities Requiring Licensure

Resident Wholesale Distributors: Any entity physically located in Virginia engaged in wholesale distribution of prescription drugs, including those distributing to pharmacies, practitioners, or other wholesale distributors.

Non-Resident Wholesale Distributors: Any out-of-state entity shipping prescription drugs into Virginia must obtain a Virginia non-resident wholesale distributor license. Virginia does not recognize reciprocal licensing agreements that waive this requirement.

Third-Party Logistics Providers (3PLs): Entities that provide or coordinate warehousing or other logistics services on behalf of a manufacturer, wholesale distributor, or dispenser, but do not take ownership of prescription drugs, must obtain a separate 3PL license (resident or non-resident).

Warehouse Distributors: Entities that warehouse prescription drugs on behalf of others.

Repackagers: Entities engaged in repackaging prescription drugs for distribution must hold appropriate wholesale distributor licensure.

Exemptions

  • Manufacturers distributing their own FDA-approved products (manufacturers must register with the Board but are not required to hold a wholesale distributor license for distribution of their own products)
  • Pharmacies distributing to other pharmacies under specific conditions (intra-company transfers, emergency situations — typically limited to 5% of sales)
  • Licensed healthcare practitioners dispensing to their own patients
  • Common carriers acting solely as transportation agents
  • Federal facilities operating under federal authority
  • Retail pharmacies conducting occasional sales to licensed practitioners for office use (not to exceed 5% of total prescription drug sales)

Important: Virginia does not recognize "virtual" wholesale distributors without physical facilities. All wholesale distributors must maintain a physical location subject to inspection.

  1. Submit Application: Complete application form with all required attachments and fees through online portal or mail.
  1. Background Checks: Submit to required criminal background checks and fingerprinting for designated representative and key personnel.
  1. Application Review: Board staff conducts initial completeness review. Incomplete applications will be returned or placed on hold.

- Non-resident applicants: Board may conduct inspection or accept recent home-state inspection

  1. Deficiency Correction: Address any deficiencies identified during review or inspection.
  1. Board Approval: Complete applications are reviewed by Board staff or may require formal Board consideration at monthly meeting (depending on application complexity and any identified issues).
  1. License Issuance: Upon approval and verification of all requirements, license is issued.

Processing Time

Processing times vary significantly based on application completeness, inspection scheduling, and VAWD accreditation status:

  • Complete applications with current VAWD accreditation: 60-90 days
  • Applications requiring facility inspection: 90-180 days or longer

Verify current processing times with the Board as they fluctuate based on application volume and staffing.

Out-of-State Applicants

Non-Resident Wholesale Distributor Requirements

Virginia License Mandatory: All wholesale distributors shipping prescription drugs into Virginia from out-of-state locations must hold a valid Virginia non-resident wholesale distributor license. No exemptions exist for entities licensed in other states.

Home State License: Must maintain active, unrestricted wholesale distributor license in state of physical location.

Inspection Requirements:

  • Non-resident facilities must be available for inspection by Virginia Board investigators
  • The Board will accept:

- Current NABP VAWD accreditation in lieu of Virginia facility inspection (most common pathway)

- Recent inspection by the home state board of pharmacy (typically within the past 2 years) at the Board's discretion

  • Acceptance of home-state or VAWD inspections does not permanently waive Virginia's inspection authority
  • Applicants must consent to Virginia Board inspection as condition of licensure

Agent for Service of Process: Non-resident applicants must designate a registered agent in Virginia for service of process and regulatory communications.

Compliance with Virginia Laws: Non-resident distributors must comply with all Virginia statutes and regulations, including:

  • Virginia pedigree and chain of custody requirements
  • Virginia prescription drug distribution standards
  • Reporting requirements for adverse events, thefts, significant losses, and recalls

Ongoing Reporting: Must notify Virginia Board within 30 days of:

  • Changes in licensure status in any state
  • Disciplinary actions by any regulatory authority
  • Changes in designated representative
  • Changes in business structure or ownership
  • Facility relocations or closure

Verify all current fees directly with the Virginia Board of Pharmacy before submitting payment at www.dhp.virginia.gov/pharmacy.

Renewal Requirements

Renewal Cycle

  • Annual renewal required for all wholesale distributor and third-party logistics provider licenses
  • Expiration Date: December 31st of each year (all licenses expire on this date regardless of initial issuance date)

Renewal Process

  1. Renewal Notification: The Board typically sends renewal notifications electronically or by mail 60-90 days prior to expiration to the email/address on file.
  1. Submission Method:

- Preferred: Online renewal through the Virginia DHP online services portal (dhp.virginiainteractive.org)

- Alternative: Paper renewal applications by mail to the Board office

  1. Required Information:

- Confirmation of continued operation at licensed location(s)

- Updated contact information

- Disclosure of any disciplinary actions, criminal convictions, or regulatory changes since last renewal

- Confirmation of continued VAWD accreditation (if applicable)

  1. Payment: Renewal fee must accompany renewal application.
  1. Deadline: Renewal applications and fees must be received by December 31st.

Grace Period and Penalties

No Grace Period: Virginia does not provide a formal grace period for expired licenses. Operation as a wholesale distributor with an expired license is considered practicing without a license and is subject to disciplinary action.

Late Renewal: Licenses renewed after December 31st are subject to late fees and potential penalties. The Board may assess additional fees for late renewals submitted within a limited time after expiration. Verify current late renewal window with Board.

Operating with Expired License:

  • Constitutes a violation of the Drug Control Act
  • Subject to administrative sanctions including fines, license suspension, or revocation
  • Monetary penalties may be assessed per violation or per day of operation
  • All distributions made while license is expired may be considered violations
  • Criminal penalties may apply for willful violations

Reinstatement: Licenses that have been expired for extended periods may require full new application rather than simple late renewal, including new inspection and background checks.

Continuing Requirements

  • Wholesale distributors must maintain VAWD accreditation (if obtained) throughout the license period
  • Maintain current state licenses in all states of operation
  • Maintain current DEA registration
  • Maintain required surety bond
  • Report any material changes to the Board within required timeframes (14 days for change in designated representative, 30 days for other material changes)

ColdChainCheck Data Snapshot

Virginia's wholesale drug distributor landscape shows moderate compliance positioning, with an average compliance score of 59/100 and a median of 60/100 across 409 tracked entities. The state maintains a strong active license rate of 91% (728 active licenses out of 800 total), indicating robust regulatory adherence among entities operating in the Commonwealth. However, NABP accreditation penetration is relatively low — only 33 entities (8% of tracked entities) hold Verified-Accredited Wholesale Distributors (VAWD) accreditation, compared to 408 entities (99.8%) with FDA registration. This gap suggests that while nearly all Virginia-licensed distributors meet federal registration requirements, voluntary third-party accreditation remains underutilized. The 72 expired licenses represent entities that have either ceased operations, relocated, or failed to complete annual renewals. See the ColdChainCheck methodology for details on how compliance scores are calculated.
