Oklahoma Wholesale Drug Distributor Licensing Guide

Overview

Wholesale drug distributors operating in Oklahoma must obtain an annual license from the Oklahoma State Board of Pharmacy, with a separate license required for each physical facility. Oklahoma requires non-resident distributors shipping into the state to hold both an Oklahoma license and a valid license from their home jurisdiction.

Regulatory Authority

The Oklahoma State Board of Pharmacy (OSBP) regulates wholesale drug distributors under Title 63 O.S. § 63-1-1119 and Oklahoma Administrative Code § 535:20-7-3 through 535:20-7-4. Title 63 O.S. § 63-1-1119 requires manufacturers, wholesalers, and brokers of drugs to obtain an annual license from the Board.

The Board is located at 2920 N Lincoln Blvd, Suite A, Oklahoma City, OK 73105. Contact: (405) 521-3815 or pharmacy@pharmacy.ok.gov. Office hours: Monday-Friday, 8:00 AM - 4:30 PM (excluding holidays).

Controlled substance registrations fall under the separate jurisdiction of the Oklahoma State Bureau of Narcotics and Dangerous Drugs Control (OBN) per Title 63 O.S. § 63-2-302.

Who Must Be Licensed

Any person or entity engaged in the wholesale distribution of prescription drugs in, from, or into Oklahoma must hold a wholesale distributor license issued by the Oklahoma State Board of Pharmacy. Each physical location requires a separate license.

Entity types requiring licensure:

  • Resident wholesale distributors (facility-specific)
  • Non-resident wholesale distributors shipping into Oklahoma
  • Third-party logistics providers (3PLs) purchasing from manufacturers, other 3PLs, or wholesale distributors
  • Repackagers (separate Repackager License required, $400 initial fee)
  • Manufacturers engaged in wholesale distribution activities

Operational restrictions:

  • Wholesale distributors cannot operate from residences
  • Wholesale distributors cannot be co-located with retail pharmacies

Exemptions:

  • Brokers who procure shipments without physically handling products (must list name and address annually with the Commissioner of Health)
  • Board of Pharmacy-licensed medical gas manufacturers/sellers
  • Agents and employees acting within the usual course of business for a licensed entity

Application Requirements

Per OAC § 535:20-7-4, applications must include:

  • Application form (paper, notarized — download from Board website)
  • Business information: legal name, physical address, phone, entity type, ownership structure (up to 2 levels), FEIN
  • Facility information (separate application per location)
  • Designated representative: name, Social Security number, date of birth (changes reported within 10 days)
  • Facility manager: name, SSN, DOB (changes reported within 10 days)
  • Criminal background checks and fingerprinting for applicant (if individual) and all designated facility managers
  • Surety bond meeting federal Drug Supply Chain Security Act (DSCSA) requirements
  • Proof of federal compliance: FDA registration, internal policies and procedures
  • Application fee: $400 (initial)

The Board conducts facility inspections. Licenses and most recent inspection reports must be publicly displayed at the facility.

Out-of-State Applicants

Non-resident wholesale distributors distributing into Oklahoma must:

  • Hold an Oklahoma wholesale distributor license issued by the Board of Pharmacy
  • Hold a current, valid license from their home state (or Canadian province) with comparable licensing standards
  • Obtain a separate Oklahoma license for each out-of-state facility shipping into the state
  • Submit to Oklahoma jurisdiction for enforcement purposes

Reciprocity: Available if the home state or Canadian province maintains comparable licensing standards and extends reciprocity to Oklahoma licensees. Non-resident facilities may qualify for reciprocal inspection acceptance if home state standards are deemed comparable; otherwise, Oklahoma Board inspection is required.
