Regulatory Authority

The Kentucky Board of Pharmacy (KYBOP) regulates wholesale drug distribution in the state under KRS Chapter 315, the Kentucky pharmacy practice act. Specific wholesale distributor licensing provisions are codified in KRS 315.350, KRS 315.402, and KRS 315.406. Who Must Be Licensed

The following entity types require a Kentucky wholesale drug distributor license:

  • Resident wholesale distributors — facilities physically located in Kentucky
  • Nonresident wholesale distributors — out-of-state facilities distributing prescription drugs into Kentucky
  • Virtual wholesale distributors — entities acting as wholesale distributors without taking physical possession of drugs
  • Medical gas wholesalers — distributors of medical gases
  • Third-party logistics providers (3PLs) — licensed separately under KRS 315.4102 with distinct requirements
  • Manufacturers engaging in wholesale distribution — when distributing outside normal manufacturing operations

Each facility location requires a separate license. Licenses are nontransferable — changes in name, ownership, or location trigger a new license requirement. Changes must be reported to the Board within 10 days.

Exemptions: Kentucky exempts certain entities from the surety bond requirement (but not from licensing itself), including publicly-held companies, medical gas wholesalers, distributors licensed in states with comparable bond requirements, and distributors operating within a single health care entity under common ownership.

Application Requirements

For All Applicants

  • Score of 75% or higher on Board-administered examination covering federal and state wholesale distribution laws
  • Employed full-time by the applicant in a managerial-level position
  • Physically present at the facility during regular business hours
  • Serving as designated representative for only one facility at a time
  • No disqualifying convictions related to prescription drug distribution or felonies

For Nonresident Applicants (Additional)

  • Copy of resident state wholesaler permit
  • Verification of license status from resident state
  • Most recent inspection report from resident state or FDA
  • Disciplinary history disclosure (if applicable)

Application Process

  1. Create an account in the Licensure Gateway Portal at pharmacy.ky.gov
  2. Complete the Wholesaler Initial Application online, including all required fields
  3. Upload supporting documentation: surety bond, designated representative information, DEA registration, and resident state license (for nonresident applicants)
  4. Submit application fee ($150) via online payment or check
  5. Board reviews application and evaluates applicant qualifications, including any convictions related to drug distribution and history of license suspensions or revocations
  6. Pre-licensing facility inspection conducted by the Board for new in-state facilities (required before license issuance)
  7. License issued upon approval — must be publicly displayed at the facility

Out-of-State Applicants

Nonresident wholesale distributors shipping prescription drugs into Kentucky must meet all standard licensing requirements plus additional documentation:

Renewal Requirements

Renewal Cycle: Annual. All wholesale drug distributor licenses expire on September 30 following the date of issuance, regardless of when during the year the license was initially granted.

Renewal Process:

  2. Pay renewal fee ($175 for wholesale distributors, $400 for 3PLs)
