Who Must Be Licensed
Any person or entity engaged in wholesale distribution of prescription drugs—manufacturing in Arkansas, shipping into Arkansas, or selling within Arkansas—must hold a valid permit under Ark. Code Ann. § 20-64-505.
Entity Types Requiring Licensure
- Resident wholesalers: Each physical location requires a separate permit
- Non-resident wholesalers: Must obtain the same permit if shipping or selling into Arkansas
- Third-party logistics providers (3PLs): Must obtain a wholesale distributor permit whether serving as a 3PL or using a 3PL

Exemptions
Wholesale distribution does not include:
- Intracompany sales
- Acquisitions by healthcare entities that are group purchasing organization (GPO) members
- Emergency transfers between hospitals or healthcare entities
- Acquisitions by retail pharmacies for their own use
- Charitable organization acquisitions
- Drug sample distribution by manufacturer/distributor representatives
Application Requirements
Applications must include all of the following:
- Business name, DBAs, federal Tax ID/EIN
- Physical address and mailing address
- Contact person (name, title, phone, email)
- Type of operation (pharmacy, hospital pharmacy, business office, repacker, warehouser, reverse distributor, 503B outsourcing, 3PL, or other)
- Ownership information: for sole proprietorships (owner name); partnerships (all partners); corporations (all officers/directors, stockholders holding 20%+ voting stock unless publicly traded); LLCs (all members/managers)
- Applicant history affidavits addressing: current investigations, prior disciplinary actions, convictions related to pharmacy practice or controlled substances, criminal history of owners/officers/directors, prior permit denials, loss or theft of controlled substances
- Arkansas-licensed Pharmacist in Charge: name, AR license number, hours per week (minimum 32), degree held, reciprocity application details if applicable
- Copy of home state wholesale distributor license/permit OR statement that home state does not require licensure (out-of-state applicants)
- Copy of most recent facility inspection report from home state regulatory agency OR statement that facility has never been inspected
- Copies of all federal licenses or permits (DEA registration if shipping controlled substances, FDA permits)
- Current certificate of insurance showing product liability coverage
- 3PL identification if using or serving as a 3PL: company name, address, product descriptions
- Reverse distribution details if applicable: entities from which returned drugs are received, product types

Application Process

Out-of-State Applicants
Non-resident wholesale distributors shipping or selling prescription drugs into Arkansas must meet the same requirements as in-state distributors, plus:
- Submit copy of wholesale distributor license/permit issued by the home state, OR a statement from the home state Board of Pharmacy that licensure is not required
- Submit copy of most recent facility inspection report from the home state regulatory agency, OR a statement confirming the facility has never been inspected
- Designate an Arkansas-licensed Pharmacist in Charge who is physically present at the licensed facility location and works a minimum of 32 hours per week
- Obtain a separate permit for each physical location conducting distribution operations
No physical presence in Arkansas is required, but the application must clearly identify the primary facility conducting distribution activities. Non-resident distributors must comply with Ark. Code Ann. § 20-64-506 shipment restrictions, verifying recipients are licensed physicians, dentists, veterinarians, podiatrists, licensed hospitals, licensed wholesale distributors, licensed pharmacies, or other entities authorized by law.

Late renewal penalty: $20.00 per month beginning February 1 after expiration.

Renewal Requirements
Renewal cycle: Biennial. Permits expire December 31 of even-numbered years (e.g., December 31, 2026, December 31, 2028).
Deadline: Renewal application and fee must be submitted on or before December 31 of the expiration year.
Grace period: Late renewals accepted through March 31 (90 days after expiration) with penalties.
Late penalty: $20.00 per month starting February 1 following expiration.
Voided permits: If renewal fee is unpaid by April 1, the permit becomes null and void. A completely new application must be submitted—no reinstatement process exists.
